Hello IMVU Support Team,

I hope you are well. I am ICM1, a Colombian content creator on your platform. I am writing to express my strong objection to the suspension of my account, which I believe was carried out in error, without justification or evidence—and which continues to harm my work as a creator. Please review this matter urgently, provide the specific evidence involved, and restore my access immediately.


1. Suspension without evidence or notification is unjust

Your email states that photos on my public profile violated your GA policy, leading to the removal of images and a 24-hour suspension. However, I was given no links, screenshots, filenames or any clear indication of which content triggered your action. I did not have the chance to understand, correct, or defend my content. This lack of transparency prevents me from addressing any issue fairly.

Such unilateral enforcement violates basic contractual due process in digital platforms, as recognized under Colombian law through Supreme Court Ruling T‑534/2023, which mandates that users must be informed of specific allegations, given the chance to respond, and treated with neutrality and transparency.


2. Violation of my rights as a digital consumer

As an active user who invests time and resources in IMVU—developing avatars, designs, interactives, and engaging with a paying audience—I am entitled to rights as a digital consumer under Colombia’s Consumer Protection Statute (Law 1480 of 2011).
This law requires platforms to provide clear, accurate, and sufficient information before disrupting service or removing posted material, and to allow access to a complaint and appeal process (Art. 50(b), 53 and 56). IMVU has not allowed me any means to dispute or appeal the decision, a practice that is not aligned with these legal obligations (practiceguides.chambers.com).


3. Breach of my rights to access and correct personal data

By deleting my images and limiting account access without explanation, IMVU is also interfering with my personal data and creative property, which are protected under Law 1581 of 2012 (Colombian Personal Data Protection Law / Habeas Data Law). This law explicitly grants individuals the right to know what personal data or content led to adverse decisions, and to request corrections, removals, or explanations if they are deemed inaccurate or unjustified (clym.io).

Without access to the reasons or content in question, I cannot exercise any of these rights. The removal process has been automatic and opaque, allowing no recourse.


4. Adverse impact on my creative activity

As a creator, I rely on regular access to my account to interact with clients, maintain my catalog, and fulfill orders. A suspension—even temporary—interrupts income streams, damages my reputation, and reduces my visibility. This unilateral action thus unfairly resets work I’ve built and may deter future opportunities on your platform.


5. What I am requesting

In light of the above, I respectfully request the following actions:

  1. Immediate reinstatement of my full account access and removal of any blocks or flags.

  2. Disclosure of the specific content(s) claimed to have violated your policy (e.g. image links or filenames), so I may verify and, if necessary, remove or correct them.

  3. A fair opportunity to explain or correct any misunderstanding, consistent with principles of transparency and due process.

  4. Assurance that if no violation is found, the incident will not leave a permanent negative mark on my account history.


6. Next steps and potential escalation

I expect a clear response within 5 business days. If I do not receive due process or a justified explanation, I may have to escalate this matter to the Superintendence of Industry and Commerce of Colombia (SIC) for violation of consumer rights and habeas data protections, and—if necessary—pursue legal remedies via the tutela mechanism for violations of fundamental rights to due process and data accountability.


I appreciate your prompt attention to this matter. I believe we can resolve this amicably and transparently.
